These Terms of Use are in effect when you utilize any services offered by talk2us.ai or its associated entities, which include but are not limited to our application programming interface, software, tools, developer resources, data, documentation, and websites, collectively referred to as "Services". These Terms incorporate our Service Terms, Sharing & Publication Policy, Usage Policies, and any other written documents, guidelines, or policies we may provide. 1. Our Services

You must be at least 13 years old to use our Services. If you are under 18, it is mandatory to obtain consent from your parent or legal guardian to use the Services. If you represent another individual or entity in using the Services, it is essential that you possess the authority to accept these Terms on their behalf. When registering for an account, it is required that you provide truthful and comprehensive information. Sharing your access credentials or account with individuals beyond your organization is prohibited, and you assume responsibility for all actions performed under your account credentials.

(c) Limitations: You are prohibited from (i) utilizing the Services in a manner that infringes, misappropriates, or violates any individual's rights; (ii) reverse engineering, decompiling, translating or attempting to uncover the source code or underlying elements of models, algorithms, and systems of the Services (except where such limitations are in conflict with applicable law); (iii) using output from the Services to create models that compete with talk2us.ai; (iv) misrepresenting output from the Services as human-generated when it isn't, or otherwise violating our Usage Policies; (vii) sending us personal information of children under 13 or the applicable age of digital consent. You are allowed to use Services only in geographies currently supported by talk2us.ai.

(d) Third Party Services: Any third-party software, services, or other products you utilize in conjunction with our Services are governed by their respective terms, and we hold no responsibility for such third-party products.

3. Content

(a) Your Content: You may input data into the Services ("Input") and obtain generated output returned by the Services based on this Input ("Output"). Both Input and Output are collectively referred to as "Content". As far as permitted by relevant law and between the involved parties, you retain ownership of all Input. Provided that you comply with these Terms, talk2us.ai hereby transfers to you all its rights, title, and interest in and to the Output. This implies that you can utilize Content for any purpose, including commercial objectives such as sale or publication, as long as you adhere to these Terms. talk2us.ai may utilize Content to deliver and sustain the Services, adhere to applicable laws, and enforce our policies. You bear responsibility for the Content, including ensuring that it does not breach any relevant law or these Terms.

(b) Similarity of Content: Given the inherent characteristics of machine learning, Output may not be exclusive to individual users, and the Services may generate identical or similar output for talk2us.ai or a third party. For instance, if you input a query like "What color is the ocean?" and receive a response such as "The ocean is blue", similar queries from other users may yield the same answer. Responses that are solicited by and generated for other users do not fall under the definition of your Content.

(c) Utilization of Content to Enhance Services: We may utilize Content from Services to aid in the development and enhancement of our Services.

(d) Accuracy: The domains of artificial intelligence and machine learning are progressing rapidly. We continually strive to enhance our Services to make them more precise, dependable, secure, and advantageous. However, due to the probabilistic nature of machine learning, usage of our Services might occasionally yield inaccurate Output that doesn't accurately represent real individuals, locations, or facts. You should assess the accuracy of any Output according to your specific use case, including employing human review of the Output.

4. Restricted activities

The Services should only be accessed and used for purposes which we explicitly endorse. Any commercial usage of the Services, unless specifically approved by us, is strictly prohibited.

As a user of the Services, you commit to not:

(a) Systematically retrieve data or other content from the Services to form or compile, directly or indirectly, a collection, database, or directory without our written permission.

(b) Trick, defraud, or mislead us and other users, particularly in any attempt to obtain sensitive account information such as user passwords.

(c) Bypass, disable, or interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Services.

(d) Disparage, tarnish, or otherwise harm, in our view, us and/or the Services.

(e) Use any information obtained from the Services to harass, abuse, or harm another person.

(f) Misuse our support services or submit false reports of abuse or misconduct.

(g) Use the Services in a manner inconsistent with any applicable laws or regulations.

(h) Engage in unauthorized framing of or linking to the Services.

(i) Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Services.

(j) Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

(k) Remove the copyright or other proprietary rights notice from any Content.

(l) Attempt to impersonate another user or person, or use the username of another user.

(m) Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including clear graphics interchange formats ("gifs"), 1x1 pixels, web bugs, cookies, or other similar devices.

(n) Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.

(o) Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.

(p) Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.

(q) Copy or adapt the Services' software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

(r) Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.

(s) Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services.

(t) Use a buying agent or purchasing agent to make purchases on the Services.

(u) Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.

(v) Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.

(w) Please communicate respectfully when interacting with our AI, avoiding any form of personal attacks, harassment, or discriminatory language. Sharing explicit, sexual, hateful, self-harm, illicit, violent, or offensive material is strictly prohibited, as is engaging in or promoting illegal activities. Ensure your contributions are relevant and refrain from posting unsolicited promotions or spam. Protect your privacy and that of others by not sharing personal information. Additionally, do not impersonate others or share content that infringes on intellectual property rights, is defamatory, misleading, or deceptive.

5. Confidentiality

(a) Confidentiality. As part of the Services, you may gain access to Confidential Information from talk2us.ai, its affiliates, and other third parties. You are permitted to use this Confidential Information solely for the purpose of using the Services, in accordance with these Terms. You must not disclose this Confidential Information to any third party, and should protect it in the same manner as you would protect your own confidential information of a similar nature, utilizing at least reasonable care. Confidential Information refers to nonpublic information that talk2us.ai, its affiliates, or third parties designate as confidential or that should reasonably be considered confidential under the circumstances. This includes software, specifications, and other nonpublic business information. Confidential Information does not include information that: (i) becomes generally available to the public through no fault of yours; (ii) was already in your possession without any confidentiality obligations when you received it under these Terms; (iii) is rightfully disclosed to you by a third party without any confidentiality obligations; or (iv) is independently developed by you without using Confidential Information. You may disclose Confidential Information when required by law or a valid order from a court or other governmental authority, provided you give reasonable prior written notice to talk2us.ai and make reasonable efforts to limit the scope of disclosure. This includes assisting us in challenging the disclosure requirement, where possible.

(b) Security. You are required to implement reasonable and appropriate measures designed to secure your access to and use of the Services. If you discover any security vulnerabilities or breaches related to your use of the Services, you must promptly contact talk2us.ai and provide details of the vulnerability or breach.

(c) Processing of Personal Data. If you utilize the Services to process personal data, you must provide legally adequate privacy notices and obtain necessary consents for the processing of such data. You represent to us that you are processing such data in accordance with applicable law. If you plan to use the talk2us.ai API for processing "personal data" as defined by the GDPR or "Personal Information" as defined by the CCPA, please fill out this form to request to execute our Data Processing Addendum.

6. User representations

(a) By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are not under the age of 13; (5) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Services; (6) you will not access the Services through automated or non-human means, whether through a bot, script or otherwise; (7) you will not use the Services for any illegal or unauthorized purpose; and (8) your use of the Services will not violate any applicable law or regulation.

(b) If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

7. User registration

(a) You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password.

(b) We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

8. Purchase and payment

(a) You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

(b) Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time.

(c) You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order.

(d) If your order is subject to recurring charges, then you consent to our charging your payment method on a recurring basis without requiring your prior approval for each recurring charge, until such time as you cancel the applicable order.

(e) We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

(f) We reserve the right to refuse any order placed through the Services. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

(g) These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

8. Cancellation

(a) You can cancel your subscription at any time by contacting us using the contact information provided below. Your cancellation will take effect at the end of the current paid term.

9. Contribution license

(a) You and Services agree that we may access, store, process, and use any information and personal data that you provide and your choices (including settings). By submitting suggestions or other feedback regarding the Services, you agree that we can use and share such feedback for any purpose without compensation to you.

(b) We do not asert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Services. You are solely responsible for your Contributions to the Services and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

10. Term and termination

(a) Termination; Suspension. These Terms take effect when you first use the Services and remain in effect until terminated. You may terminate these Terms at any time for any reason by discontinuing the use of the Services and Content. We may terminate these Terms for any reason by providing you at least 30 days' advance notice. We may terminate these Terms immediately upon notice to you if you materially breach Sections 2 (Usage regulations), 5 (Confidentiality), if there are changes in relationships with third party technology providers outside of our control, or to comply with law or government requests. We may suspend your access to the Services if you do not comply with these Terms, if your use poses a security risk to us or any third party, or if we suspect that your use is fraudulent or could subject us or any third party to liability.

(b) Effect on Termination. Upon termination, you will stop using the Services and you will promptly return or, if instructed by us, destroy any Confidential Information. The sections of these Terms which by their nature should survive termination or expiration should survive.

11. Modifications and interruptions

(a) We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Services. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

(b) We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors.

(c) We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Services at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance of the Services.

A note on accuracy: Services like talk2us.ai generate responses by interpreting a user's request and then predicting the most likely subsequent words that might appear in response. Occasionally, the most probable next words may not be the most factually accurate ones. Therefore, you should not rely on the factual accuracy of output from our models. If you observe that talk2us.ai output contains factually incorrect personal information about you and you want us to rectify the inaccuracy, you may submit a correction request to contact@talk2us.ai. Given the technical complexity of our models, we may not be able to rectify the inaccuracy. In such a scenario, you can request that we remove your personal information from talk2us.ai's output by emailing contact@talk2us.ai.

5. Children
